Terms and Conditions for Publishing on PicoLibo Effective Date: 24 October 2024 Welcome to PicoLibo. By using our tools to create and publish your book, you agree to the following terms and conditions:
1. Ownership and Rights
1.1 Platform Rights: By publishing on PicoLibo, you grant the platform exclusive rights to publish, distribute, modify, and sell the book created using the platform’s tools. This includes any AI-generated content such as images, layouts, and specific text elements. 1.2 Author Rights: You retain ownership of the original story elements you contributed. However, all rights to the published book, including the final text and AI-generated content, are assigned to the platform. 1.3 Derivative Works: PicoLibo retains exclusive rights to any adaptations or derivative works, including translations, audiobooks, film, or merchandise. The platform may license these rights to third parties without further approval from the author.
2. Royalties
2.1 Royalty Rates: In exchange for granting PicoLibo substantial rights to your book, you will receive a royalty rate of 20% of the net sales revenue generated from the sale of your book on the platform. This royalty rate applies to both digital and print formats. 2.2 Sales Milestones: You may be eligible for additional bonuses based on specific sales milestones, as outlined in your publishing agreement. 2.3 Payment Schedule: Royalties will be calculated and paid quarterly, with payments made via [insert payment method] within [X] days of the end of each quarter.
3. Author Use
3.1 Exclusive Distribution: The book created and published using PicoLibo is exclusively distributed through our platform and partners. You may not sell, license, or distribute the book, or any part of it, outside of the platform without written permission from PicoLibo. 3.2 Author Promotion: You are encouraged to promote your book using PicoLibo's tools and channels. However, all sales must occur through the platform.
4. Creative Control
4.1 Platform Editorial Rights: PicoLibo retains full editorial control over the final content, cover design, and marketing strategies for your book. While your input is welcome, the platform reserves the right to make the final decisions. 4.2 AI-Generated Content: All AI-generated content used in your book (such as illustrations, layouts, and generated text) remains the property of PicoLibo. This content may not be used or reproduced outside of the platform.
5. Termination and Reversion of Rights
5.1 Termination: Either party may terminate this agreement with [X] days’ written notice. Upon termination, all rights to the published book remain with PicoLibo, except for any original story elements that belong to the author. 5.2 Reversion of Rights: If the book is taken out of print or if sales fall below a certain threshold (to be specified), you may request the reversion of certain rights. Reversion terms will be negotiated on a case-by-case basis.
6. Miscellaneous
6.1 Governing Law: This agreement is governed by the laws of Singapore. 6.2 Entire Agreement: This agreement constitutes the entire understanding between the parties and supersedes all prior agreements regarding the subject matter.
